Dispute Resolution (Litigation And Alternative Disputeresolution)

Litigation has been a cornerstone of the Firm’s practice since its inception. We have been retained by domestic and multinational companies as lawyers for their significant litigation matters. G. Giri & Company’s litigation practice is amongst the most reputed and active practices in the national capital. The Firm represents, both Indian and International clients on Civil, Criminal, Insurance, Intellectual Property, Product Liability, Debt Recovery, Labor and Employment, Competition Law, Administrative Law cases and other commercial litigation matters.

The Firm, on a regular basis, represents clients before the Hon’ble Supreme Court of India, various state High Courts, District Courts, Debts Recovery Tribunal, Electricity Appellate Tribunal, National Company Law Tribunal, Consumer Fora, and other Judicial/Quasi-Judicial Fora, etc. The Firm also assists on matters related to insolvency, winding-up of companies, restructuring and corporate litigation, taxation at appellate level, etc. for matters pending in the Tribunals, High Courts and Supreme Court of India. Our approach towards any litigation is to understand the issue(s) at hand and its genesis, sensitivities involved in the matter, a thorough examination of case law and precedents in order to adhere to and understand the procedural developments in jurisdiction(s) across the country relevant to the matter at hand.

Apart from litigation and corporate commercial matters the Firm is equally involved in conducting domestic and international arbitration. Realizing the importance of and the value in adopting alternate means for dispute resolution such as mediation, negotiations, reconciliation and arbitration, the Firm, in-principle, advises its clients against litigation. It is our firm belief that appropriate legal advice at early stages of a dispute resolves matters in a speedy and cost-efficient manner.

The founder of Firm Mr. Gajendra Giri is also empanelled with Delhi International Arbitration Centre (DIAC) and is presently conducting several arbitrations for the same.

Real Estate Practice

The Firm’s Real Estate practice includes carrying out due diligence of land records, across various states of India, wherein we verify the land records, trace titles and determine if the land is legally free for acquisition. Our clients include companies who to buy lands for setting up plants, factories and warehouses. We also advise several Banks and NBFC’s in assessing if the property offered for mortgage is worthy for accepting as collateral.

Documentation of transactions is an integral part of our real estate practice.

Intellectual Property

The Intellectual Property Practice Group of the Firm has significant experience in IP based transactional and regulatory matters in addition to cross border litigation for protection and enforcement of Intellectual Property rights. The Firm advises and represents Clients in relation to Prosecution and Registration of Trademark, Parent, Copyright& Designs, assists and advises on IP audits and due diligence, enforcement litigation including anti piracy, counterfeiting and passing off litigation. Lawyers of the Firm have extensively assisted in negotiating contractual arrangements from the standpoint of protection of intellectual property including post termination restriction on use of intellectual property, joint ownership and assignments.

Family Law Practice

Our family law practice includes assistance in adjudication of succession issues amongst family members arising out of testamentary and intestate succession. We specialize in petitions for grant of probates, letters of administration, succession certificate and Partition suits.

We draft Wills for the Clients and assist them in getting the same registered before the competent offices. Our services also include matrimonial disputes which inter-alia includes Petitions for Divorce, Restitution of conjugal rights, Alimony, Maintenance, custody of children, Domestic Violence etc.

Consumer Litigation

An important branch of our litigation is consumer litigation, which is spread over several districts situated in Delhi, Punjab, Uttrakhand, Gujarat, Madhya Pradesh, Uttar Pradesh, Rajasthan, Orissa, Tamil Nadu and Kerala.

We have our presence in almost every district of above mentioned states filing/defending claims against our Clients in the Consumer Disputes Redressal Forum and before the State Commission. Our Delhi office attends to matters before the National Commission, State and District Consumer Forums.

Food & Beverage

Lawyers of the Firm have in depth knowledge and specialization in regulatory issues and legislations impacting the Food & Beverage industry and have extensively advised national and multinational companies on matters relating to product labelling, permissibility of ingredients, legal metrology and weights and measures. Lawyers of the Firm have extensively represented Clients before the Food Safety & Standards Authority in relation to obtaining product approvals, formulation of product standards and have been instrumental in obtaining precedent setting judgments from the State High Courts and the Supreme Court of India with regard to interpretation of provisions of food laws including the Prevention of Food Adulteration Act, 1954 and Food Safety & Standards Act, 2006.

Pre-litigation Mediation

Pre-Litigation Mediation is an upcoming and voluntary process in which an impartial and neutral mediator tries to bring together the disputant parties to arrive at a mutually agreeable solution. The Firm with the help of trained mediator, constantly attempt to resolve the dispute amicably and cordially with a collaborative approach. The concept of Pre-Litigation Mediation saves time, money, energy and relationships and provides more satisfaction and peace of mind to the parties in dispute.

Banking & Insolvency Law

Introduction of Insolvency and Bankruptcy Code 2016 has opened a new fora National Companies Law Tribunal. We represent Banks/Financial Institutions before the said foras in pressing their claims for insolvency of a defaulting creditor.

Pro-bono Publico

Pro bono litigation is an integral part our legal services. We believe in paying back to the Society thus provide free legal assistance to the underprivileged. We would be happy to provide assistance to anyone needy or having a worthy cause.

Financing

The Firm undertakes projects for drafting, negotiation and execution of documentation including facility agreements and security documents such as guarantees and documents of charge and lien, assistance in refinancing the project, drafting of resolution plans and assistance in the insolvency process.

Commercial Agreements

The Firm deals in drafting, negotiation and execution of documentation including: Construction contracts, architect’s contracts, interior design consultancy contracts and other contracts for the appointment of experts for the development phase;

Equipment supply and other agreements with sub-contractors and vendors;

Drafting, negotiation and execution of documentation including joint venture agreements, investment agreements, shareholders’ agreements, private equity documentation and other equity and/or quasi-equity funding documentation;

Trademark license agreements for the license of trademarks and service marks by brand-owners. Drafting, negotiation and execution of documentation with consultants and other entities for provisions of pre-opening and post opening services;

Advice on compliance processes under all applicable laws, for example, labour law, corporate law, indirect tax laws and developmental and/or environmental regulations;

Advice on issues faced in the day-to-day operations of the client’s business;

Assistance in further investments into the business;

Resolution of disputes, either through the conciliation process or through arbitration.
